DialogPay offers various subscription plans with different features and pricing. All fees are billed in advance on a monthly or annual basis and are non-refundable, including for partial months of service, upgrade/downgrade refunds, or unused months with an open account. To treat everyone equally, no exceptions will be made.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle.
You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time through the interface provided within the Service. Upon cancellation, all of your content will be immediately deleted from the Service. Since deletion of all data is final, please be sure you do want to cancel your account before doing so.
DialogPay reserves the right to (i) modify or discontinue, temporarily or permanently, the Service (or any part thereof) and (ii) refuse any and all current and future use of the Service, suspend or terminate your account (any part thereof) or use of the Service and remove and discard any of your content within the Service, for any reason, including, if DialogPay believes that you have violated these Terms.
DialogPay reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Service with or without notice. Prices of all Services, including but not limited to monthly subscription plan fees, are subject to change upon 30 days' notice from us. Such notice may be provided at any time by posting the changes to the DialogPay Site (dialoguepay.com) or the Service itself.
DialogPay shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
The services provided by DialogPay are available on an 'as is' and 'as available' basis. DialogPay expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the services will meet your specific requirements or be available on an uninterrupted, secure, or error-free basis.
DialogPay shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
Any disputes arising out of or related to these Terms or the use of the Service shall be resolved by binding arbitration in accordance with the rules of [Applicable Arbitration Association].
